Benue: How herdsmen are ‘planning to kidnap, kill me’ – Governor Ortom

A DAILY POST source claimed that some political opponents working for top politicians have allegedly connived with top government officials to assassinate the governor along the ever-busy Makurdi-Lafia Road.
He said the plan was to frustrate the Governor from using any chartered flight to Abuja for political and other important meetings and consequently expose him to attack along the Makurdi-Lafia Road.
According to him, ‘’We have important security information that Governor Ortom is one of their targets for possible assassination. Some politicians working with top people in government are working together to ensure the Governor’s effort to secure the State is frustrated.
‘’Their plan is to attack him along Makurdi-Lafia Road. People have taken politics to a different height. We believe the world is watching and listening to our cry in Benue State,’’ the top government official told DAILY POST.
Confirming the development, the Chief Press Secretary to the Governor, Terve Akase told DAILY POST that the Governor was aware of the plan to assassinate him. He said the plan was already being carried out as there is a fresh order said to be banning all flights to Makurdi.
He said, ‘’Usually, because of the Governor’s regular meetings and other important things, he uses flight to Abuja, but now, there is an order banning all flights to Makurdi. This is a clear setup. We are also aware of the plan to assassinate him along the Makurdi-Lafia Road. This is a sad development as we believe some people are just carrying out a written script on how to silence Governor Ortom.’’

BENUE NEWS: Our Chances-brighter-without-ortom-apc-vows-boasts-as-akumes-kinsmen-pledge-loyalty-to-PDP

Perhaps Governor Samuel Ortom may have once again caught his political groove since defecting from the All Progressives Congress, APC, to the Peoples Democratic Party, PDP, few weeks back. Ortom Ortom had hinged his decision to dump the APC on the fact that he was treated as an outsider who had no say or stake in the affairs of the party haven spent over three years in the fold of the ruling party. The Governor also asserted that his decision was influenced by the people of the state who felt alienated by the APC led federal government despite their outcry and plea for help and support in the face of ceaseless bloody attacks on several Benue communities by marauding herdsmen. Since pitching tent with his former party, the PDP, the Benue political space has lightened up with not a few notable politicians in the state following suit even as thousands of APC members in the urban and rural communities are voluntarily joining the PDP train. The Governor at the time of his defection moved into the PDP with 13 elected local government council chairmen of the state, 276 elected councilors, one Senator and four House of Representatives members. A fallout of that deft political move has galvanized the PDP and out of 11 House of Representatives members, eight are of the PDP while out of three senators two are of the PDP. The exit of Governor Ortom and his ambiance with new party no doubt has left the APC devastated but the party has also moved to pick up the bits and pieces of whatever remains of its structure to put up a brave fight against the PDP in the coming general elections. But the fate of the party was made worst by the recent endorsement of the Governor by the kinsmen of his arch rival and estranged political benefactor, Senator George Akume from the Jemgbagh extraction comprising Gboko, Buruku and Tarka local government areas who thronged the Benue government house in their hundreds to pledge their unalloyed support for the Governor ahead of the 2019 elections. At that occasion, leaders of the delegation who came on the auspices of Jemgbagh Elders Forum of the PDP which also had most of the political heavy weights from the area in attendance, Mr. Sam Tsumba said the visit was to enable them register their solidarity with the Governor and to welcome him back to his former party. Tsumba said “We have come to express the determination of Jemgbah to stand behind you our Governor owing to your laudable performance in office and appointment of many of our sons into key positions including Professor Anthony Ijohor as SSG and the acting Chairman, Board of Internal Revenue Service, Mr Terzunwe Atser which would garner support for you in our area.” Others who spoke including elders Tarhule Nev, Ikyume Yongu and Mbakorlumun Chia for Buruku, Gboko and Tarka respectively said they were solidly behind the Governor to continue providing purposeful leadership for Benue people. On his part, a chieftain of the PDP in the state, Prince Yandev Amaabai said “PDP is lucky to have a ‘prodigal son’ who was pushed out of his father’s house empty handed only to return with much wealth.” They also acknowledged that the Open Grazing Prohibition Law of the state was a landmark that had helped in no small measure in reducing the activities of militant herdsmen in the state The elders vowed to recall any of their representatives in the State Assembly who was involved in the illegal impeachment move against Governor Ortom. That visit to the Governor by the Jemgbagh leaders was followed by that of the Jechira block comprising Konshisha and Vandeikya who also endorsed the governor for the 2019 gubernatorial election and pledged their loyalty to him. Leader of the delegation and senator representing Benue North East district, Senator Barnabas Gemade said Jechira remained committed to the reelection bid of the governor in next year’s elections after which the mantle would move to the area in 2023. According to Gemade, “Governor Ortom has risked his life for the sake of Benue people and what he deserved was reciprocation and not gang up by self seeking power mongers.” Speaker for the State House of Assembly, Speaker of the House, Mr. Titus Uba and council Chairman of Konshisha, Mrs. Mwuese Ubebe, said the people of Jechira were unanimous in support of the Governor’s reelection, stressing that if he wanted, he would have mortgaged the future of Benue for his personal grains. Other speakers including elders David Gbologidi, Namtsav Pever, Clement Azuanongo, Samuel Angya and Samuel Weghsha, all promised bloc votes for the Governor Ortom in 2019, saying they would be the first to reject any evil that stood in the way of the state. Mrs. Rachael Yange and Rachael Negba who paid glowing tributes to wife of the Governor, Dr. Eunice Ortom, said Jechira women had resolved to follow in the foot steps of their husbands. Mrs. Negba particularly noted that “Governor Ortom had uplifted so many women through appointments and elective positions more than any other state in the country, his commitment to empowering women is in line with one of the Millennium Development Goals.” In his separate responses Governor Ortom expressed appreciation to the people of Jemgbagh and Jechira for declaring their support for him, saying he was part of them and would continue to work in the interest of the Benue people. The Governor stated that he was persecuted because he left the APC as demanded by the people of the state noting that all petitions against him by his former party and traducers would end up in the dustbin. Highpoint of the visits was the presentation of an award of Hero of Democracy to Governor Ortom by Prof. Dennis Ityavyar Vanguard for Ortom 2019 for his landmark achievements in the face of financial constraints and insecurity. Reacting to the unfolding political drama and realignment of political forces in the state, Convener of the Middle Belt Movement for Justice and Peace, MBMJP, Comrade Joe Bukka said it was expected. Bukka said, “I recall vividly that I told you in our last discussion that Benue would witness what you see playing out today. “Like I said before now, Governor Ortom is a political enigma who despite his shortcomings like every other human being, enjoys a cult like followership across the state and many of this people were eager to have him return to the PDP because of the kind of treatment meted to him in the APC. “My only advise is that he has to carry former governor Gabriel Suswam, Senator David Mark, Comrade Abba Moro, Dr. Iyorchia Ayu and the PDP state chairman, Sir John Ngbede along because these are the people who are indispensable. “They wield a lot of influence, including members of the party occupying various elective positions at the state and national levels. If he does that, I can assure you that the PDP and Ortom are good to go in 2019. “I must also add that he has to engage the various governorship aspirants on the PDP platform who held forth while he sojourned in APC because they remain an integral part of PDP and also have their followership and may not be happy with his return to the party, though we know that Ortom gave his all during his PDP days to build the party.” “But I must also point out that every second term bid of any serving governor in Benue state has never come easy. Ortom will not find it easy as usual but at the end of the day, the people would give it to him to enable him complete the turn of his zone to allow other zones also have their turn in full. That is Benue politics for you. “You and I know that Ortom is the oldest living political tactician occupying political office in Benue today but many do not know this fact. Benue election must be free and fair because any attempt to manipulate the process would be resisted even by the people you see in the IDPs camps because they would be the first people who would pour into the streets to resist that attempt.” On his part, the Chief Press Secretary, CPS, to the Governor, Terver Akase said, “It is absolutely correct to say that the return of Governor Ortom to PDP has been greeted with a loud ovation by majority of members of the party and other Benue people. “The general applause trailing the Governor’s defecting from APC also goes to show the disappointment of the people in the APC government which has failed to protect them. “The gale of defections from APC to PDP by many top Benue politicians both elected and appointed following the Governor’s move is also indicative of the current political direction in the state. Benue people are happy with their Governor and they have vowed to stand behind him. Benue is now PDP,” Akase added. However on his part, the Director of Publicity of the APC in Benue state, Peterhut Apeh dismissed the chances of the PDP and Governor Ortom in the coming elections. Apeh said, “the various endorsement for the governor is not genuine, the governor is only trying to attract sympathy to himself. The highest they can do is media propaganda. “When it comes to voting, the APC will come out victorious. Our chances are very bright especially now that Governor Ortom has left us. We are surely working towards another victory,” Apeh added. Related

Saraki, Tambuwal, others defection unconstitutional —Falana Read more at: https://www.vanguardngr.com/2018/08/saraki-tambuwal-others-defection-unconstitutional-falana/

Human rights lawyer, Femi Falana, SAN, has faulted the defection of Senate President, Dr Bukola Saraki; Governor Aminu Tambuwal of Sokoto State, his Kwara State counterpart, Abdulfatah Ahmed, from All Progressives Congress, APC, to Peoples Democratic Party, PDP, saying, it was unconstitutional.

Falana This is even as foremost constitutional lawyer and human rights activist, Chief Mike Ozekhome (SAN), condemned call by National Chairman of  APC, Adams Oshiomole, that Senate President, Saraki, should resign as President of the Senate, after defecting from the APC to the PDP. Falana’s position came barely 24 hours after Tambuwal and 48 hours after Saraki, Ahmed and 23 lawmakers in the state defected from APC to PDP Falana, who faulted their action on the sideline during unveiling of Nobel laureate, Prof. Wole Soyinka’s new book, entitled ‘Who keeps watch over the watchman,’stressed that as stipulated in the 1999 constitution, there was no crisis in the APC to warrant their defection from the party to PDP. He said: “1979 and 1999 constitutions have prohibited cross-carpeting on the ground that you are cheating or shortchanging the electorate. And that was stated under section 68 1 (G) of the constitution. “The only provision is that if your political party is in trouble and is fractionalized, major division, you can cross over, but not a division instigated for the purpose of exiting, no. “So if you are elected on the platform of party A you don’t want that party again, you must go and seek fresh mandate on the platform of your new party. Meanwhile, Chief Mike Ozekhome (SAN), has condemned call by Oshiomhole that Saraki should resign as President of the Senate. Ozekhome in a statement made available to newsmen yesterday, said:  “In law, there is no legal or constitutional basis for Dr Bukola Saraki to resign or be removed as President of the Senate and Chairman of National Assembly for defecting from the APC to PDP.” He further explained that “the first point to make here is that section 68(1) of the 1999 Constitution provides inter alia, that any member of the 109 Senators and 360 members of the House of Representatives who loses his Nigerian citizenship, or is made a minister, or decamps from his political party to another party AUTOMATICALLY loses his seat

▼ Why I can’t be arrested, INEC Chairman, Mahmood tells Court

. says I was denied fair hearing By Ikechukwu Nnochiri ABUJA – Chairman of the Independent National Electoral Commission, INEC, Prof. Mahmood Yakubu, has challenged the validity of the arrest warrant that was issued against him by the Federal High Court in Abuja. Mahmood Yakubu In a six grounds of appeal he lodged before the Abuja Division of the Court of Appeal, the INEC boss maintained that he could not be arrested on the basis of a bench warrant he said was legally defective. He urged the appellate court to invoke its powers and void the arrest order that was issued against him by trial Justice Stephen Pam. Justice Pam had in a bench ruling on Wednesday, ordered the Nigerian Police Force to arrest and produce the INEC boss in court on August 8 to face contempt charge. The order followed Mahmood’s failure to honour a summon the court issued for him to appear with respect to a suit involving the Anambra State chapter of the Peoples Democratic Party, PDP. Prior to the ruling, the INEC Chairman had on July 5 and 10, equally failed to honour the court’s summon to appear and defend a contempt proceeding that was initiated against him by Chairman and Legal Adviser of the PDP in Anambra state, Ejike Oguebego and Chuks Okoye, respectively. The high court had ordered him to appear before it to show cause why he should not be committed to prison for refusing to recognize the Oguebego-led faction of the PDP in Anambra state in compliance with a judgment the Supreme Court delivered in December 2014. The Applicants had prayed the court to jail Mahmood for disregarding the said judgment, decrying that contrary to the apex court’s verdict, both INEC and its Chairman, continued to relate with another faction of the PDP in the state. Meantime, in a notice of appeal he lodged barely 24 hours after the arrest warrant was issued against him, Mahmood, denied disobeying any order from the high court. Insisting that he was denied fair hearing by the trial Judge, the INEC Chairman said there was no evidence that any court summon was enrolled and served on him by the court’s bailiff. He argued that the high court erred in law when it ordered that he should be arrested for allegedly disobeying its order, “when the conditions necessary to warrant the issuance of bench warrant have not been satisfied”. Mahmood’s lawyer, Chief Adegboyega Awomolo, SAN, further argued that no order was enrolled and served on his client for his personal appearance in court. “The court did not give Professor Yakubu or his counsel opportunity to explain his absence in court and why the Bench warrant should not be issued”, he added. Besides, Awomolo, SAN, faulted the court’s order of arrest on the grounds that it was “made in the absence of Professor Yakubu and such order was not enrolled or personally served on him and when the disobedience was in the nature of contempt ex-facie curie which the honourable judge has no power to punish its disobedience”. He contended that the judge acted illegally, thus rendering the bench warrant void ab-initio. More so, Awomolo told the appellate court that Justice Pam’s arrest order, “occasioned a grave miscarriage of justice”, saying the judge “punished Professor Yakubu for alleged non-obedience of the court’s order made on 5th July 2018, when there was an appeal against the order”. According to him, “The learned trial judge erred in law when he descended into the arena of conflict when he argued the case of the respondents without opportunity of hearing given to the Appellants or their counsel before striking out the motion asking for adjournment of further hearing of the alleged contempt proceedings”. He argued that the provisions of the Administration of Criminal Justice Act, ACJA, 2015, which the judge relied on, were not referred to by any of the counsel in the matter, thereby violating “the rights of the appellants preserved by Section 36 of the Constitution of the Federal Republic of Nigeria 1999”. Meanwhile, no date has been fixed for hearing of the appeal. Mahmood had before the arrest warrant was issued against him, claimed that he could not be held liable for disrespecting any court order since he was not in office in 2014 when the said apex court verdict was delivered. Awomolo told the court that his client was absent at the proceeding owing to the fact that he led a team of electoral officers from the Economic Community of West African States, ECOWAS, to Mali, on a very crucial assignment. His excuse for Mahmood’s absence in court for the third consecutive time was however rejected by Justice Pam who said he would no longer tolerate an attempt to turn his court to a toothless bulldog. “It is sad that the contemnor and his senior counsel have chosen not to obey the order of this court in respect of this contempt charge. “The contempt of the contemnor to this court can no longer be tolerated and he should not be allowed to continue to take the court for a ride”, the Judge fumed. Justice Pan said he was not convinced that the INEC boss had any justifiable reason not to attend the court proceeding as he was ordered to do. Consequently, he ordered that he should be arrested and produced in court on the next adjourned date. Earlier, the Judge struck out a motion that asked him to hands off or step aside from the matter on the premise that an appeal had been filed to challenge the legality of the court summon that was issued against the INEC boss. Justice Pam maintained that the motion amounted to an application for stay of proceeding, contrary to section 360 of the ACJA, which he said forbade the grant of a stay in criminal matters. Related

What Saraki told Ortom at PDP NEC meeting

Senate President, Bukola Saraki has hailed Benue State Governor, Samuel Ortom for his courage and determination.
Saraki said Ortom’s boldness to dump the All Progressives Congress, APC, was commendable.
The Senate President made this remark on Thursday at the 81st National Executive Council meeting of the Peoples Democratic Party, PDP.
“I want to specifically congratulate Governor Samuel Ortom of Benue State. Governor Ortom, I commend you for your courage and determination,” Saraki said.
